DUI Less Safe O.C.G.A. 40-6-391

Most people might not know that there are multiple types of DUI’s you can be charged with. When you are charged with a DUI Less Safe, it means the officer who charged you felt that although you were not driving with a BAC over the legal limit – in Georgia it is an 0.08 – your driving still constitutes as being “less safe” than if you had not ingested any alcohol.

During initial DUI investigation the officer may be looking for certain clues such as:

  • Slurred Speech
  • Bloodshot Eyes
  • Repeating Questions
  • Alcohol on Breath
  • Admission to drinking

Punishment: DUI Less safe carries the same punishment as any other type of DUI charge.
