Felony Murder O.C.G.A. 16-5-1(c)

Inherently Dangerous Felonies:

  • Burglary
  • Arson
  • Rape
  • Aggravated Assault

Punishment: If convicted of Felony Murder one can be faced with imprisonment, with or without parole, or death.

When an individual commits or is trying to commit a serious or inherently dangerous felony, and in doing so it causes the death of another individual it is considered felony murder.

Felony Murder does not require the presence of malice or intent to kill, it does, on the other hand, require the offender have the necessary criminal intent in order to commit the underlying felony.
