Voluntary Manslaughter is the killing of a human being when the offender acts irrationally in response to a sudden, violent, and serious provocation adequate enough to cause a rational individual to become emotionally and even mentally disturbed which causes them the inability to fully control themselves and their emotions.

Punishment: An individual who commits the offense of voluntary manslaughter and is convicted for such offense will be punished by imprisonment for at least one year, no more than 20.

Involuntary Manslaughter O.C.G.A. 16-5-3

Involuntary Manslaughter is known as the unintentional death of an individual due to another person’s negligence. Another definition for involuntary manslaughter is when a death occurs while another crime is being committed.


Punishment: Manslaughter due to an unlawful act can be 1 to 10 years. If the offense occurs due to a lawful act in an unlawful manner then the offense shall be considered as a misdemeanor.
Example 1

Texting and driving causing a crash into another vehicle. Ultimately, one of the passengers in the other vehicle passes away due to the accident. Because of the death of the passenger, the individual who was texting and driving was charged with involuntary manslaughter. This charge is fitting because the individual’s negligence led to the death of another individual.

Example 2
Babysitter leaves a child in the car on a hot day, the baby dies. Due to negligence they can be charged with involuntary manslaughter.
